1. Agreement to Terms

These Terms constitute a legally binding agreement between you (the user, whether a Job Seeker or an Employer/Recruiter) and Pagaar India. We reserve the right to modify these Terms at any time, and your continued usage indicates consent to the modified terms.

2. Account Registration & Security

To access certain core features of the platform, you are required to register an account. You agree to:

Be at least 18 years of age (or have active guardian consent).
Provide true, accurate, current, and complete registration information.
Maintain and secure your login password and prevent unauthorized access to your account.
Accept liability for all activities that occur under your account username and credentials.

If you suspect that your account safety has been compromised, you must notify the support team of Pagaar India immediately.

3. Specific Terms for Job Seekers

As a Job Seeker utilizing the portal to search and apply for jobs, you agree that:

Your uploaded resumes, profile info, work experience details, and portfolios represent your actual professional history. Fake credentials or certificates are strictly prohibited.
You will not apply for positions using names, contact info, or identities other than your own.
You will respect the recruiter's hiring process and will not spam employers with continuous duplicate applications or emails.
Applying to job listings on our platform is entirely free; you are under no obligation to pay any fee to apply.

4. Specific Terms for Employers & Recruiters

As an Employer or Recruiter posting jobs and reviewing candidate profiles, you agree to comply with the following:

🚨 Zero-Tolerance Recruitment Fee Policy:

Recruiters are **strictly prohibited** from asking for or charging Job Seekers any fee, training charge, security deposit, registration fee, laptop lease fee, document processing fee, or any monetary amount whatsoever at any stage of the recruitment process.

Any recruiter found requesting payment from candidates will face **immediate and permanent account suspension**, deletion of all postings, and blacklist actions.

You represent that you have the valid authority to recruit on behalf of the company listed in your profile, and may be asked to upload business proof (GST, PAN, or incorporation certificate) for verification.
You will only post active, genuine job vacancies. Fake postings, multi-level marketing (MLM) schemes, commission-only jobs not explicitly labeled, or postings promoting illegal activities are strictly forbidden.
You will comply with all local labor regulations, equal opportunity laws, and candidate data privacy expectations.

5. User Content & Intellectual Property

In these Terms, "Your Content" means any text, resumes, logos, image files, or other material you choose to upload or display on this website.

By uploading Your Content, you grant Pagaar India a non-exclusive, worldwide, royalty-free, sub-licensable license to store, process, display, and distribute it solely to facilitate the job portal services (such as delivering resumes to employers).

Other than your own user content, Pagaar India and/or its licensors own all intellectual property rights, database structures, designs, source code, and website copy. You are restricted from copying, reproducing, scraping, or commercializing any website material without prior written consent.

6. Prohibited Portal Activities

You are specifically restricted from doing any of the following on our platform:

Using any automated scripts, bots, crawlers, indexers, or scrapers to extract candidate resumes, recruiter contact information, or job details.
Attempting to bypass security systems, scan vulnerabilities, or cause a denial of service (DoS) on our web servers.
Using contact details obtained from candidate profiles to send promotional marketing spam, unrelated services, or sales pitches.
Using the portal to distribute malware, spyware, phishing links, or obscene materials.

7. Disclaimer of Warranties & Limitation of Liability

Pagaar India acts as a bridge connecting seekers and employers. We do not hire candidates directly, nor do we act as employers.

The website is provided "as is" and "as available," with all faults. Pagaar India makes no warranties that the portal will be uninterrupted, error-free, or that job search results will guarantee employment.

In no event shall Pagaar India, nor any of its founders, officers, or employees, be held liable for any damages (direct, indirect, or consequential) arising out of your use of this site, including loss of data, recruitment failures, fraudulent activities by external users, or financial transactions conducted outside the platform.

8. Account Termination

We reserve the right, in our sole discretion and without prior warning, to suspend, restrict, or terminate your account and restrict your access to Pagaar India if we believe you are in breach of any clauses of these Terms & Conditions, or if your actions present security or legal liabilities to our platform.

9. Governing Law & Jurisdiction

These Terms & Conditions will be governed by and interpreted in accordance with the laws of the Republic of India. Any legal disputes or claims arising out of the use of our services will be submitted to the exclusive jurisdiction of the competent courts located in India.
